In April 2020, our client’s life changed forever when the double-decker bus he travelled on struck a low bridge. The bus driver took an incorrect route and attempted to drive the vehicle at a significant speed under a bridge that was only suitable for single-decker buses. This critical error had a profound and life-changing impact on our client.
The accident left him with severe physical injuries, including a fractured ankle and fibula, shoulder damage, and serious psychological trauma. Over time, the physical and emotional toll became evident. Despite these challenges, his perseverance and drive to seek justice played a key role in his recovery.
Our client’s injuries profoundly affected his day-to-day life. He experienced significant mobility issues, requiring an air cast boot and crutches for basic movement. Prolonged periods of walking, standing, or even sitting became nearly impossible, while numbness in his legs added another layer of discomfort. Beyond the physical pain, the psychological impact was equally severe.
He struggled with persistent feelings of sadness, social anxiety, frustration, and emotional distress. Once routine activities, such as using public transport, became very difficult. His inability to use buses after the accident highlighted the difficulties faced by those recovering from injuries on public transport.
Seeing his difficulties, we arranged for a Case Manager to support his recovery. We worked closely with the Case Manager to arrange rehabilitation, ensuring our client received the necessary physiotherapy, psychotherapy, occupational therapy, and transport assistance.
From the outset, this case presented several obstacles. First, it involved five medical experts, each bringing a specific perspective on our client’s condition. Specialists in orthopaedics, psychology, neurology, foot and ankle injuries, and plastic surgery were instrumental in assessing the full extent of his injuries. The medical documentation alone spanned over 2,000 pages and was organised into four volumes.
In addition to the complexities of the injuries, our client’s long-term hearing impairment meant that British Sign Language (BSL) interpreters were required throughout the case. This introduced logistical and financial challenges but was essential to ensure our client could fully engage in the legal process. Effective communication was vital given his psychological state, which required sensitivity and understanding at every stage.
The COVID-19 pandemic further complicated matters, slowing down key elements of the legal process and adding delays to medical appointments and assessments. However, despite these hurdles, our team remained committed to achieving the best possible outcome for his public transport accident claim.
Given the complexity of this multi-track claim, Senior Partner Mr Ghafar Khan took a leading role in the case, working closely with legal team member Sarah Idris. Their combined expertise and dedication ensured that no detail was overlooked. They were further supported by Counsel Haroon Rashid of Kenworthy’s Chambers, whose experience was invaluable in navigating the legal challenges and preparing for a three-day trial.
Although court proceedings were initiated, the case was successfully resolved through settlement before reaching trial. This outcome spared our client the stress of a courtroom battle while ensuring a fair resolution of his claim.
In August 2024, after over four years of hard work, we were proud to secure a figure well above six figures. This amount reflects the seriousness of his injuries and provides the financial means to support his ongoing recovery.
While compensation cannot undo the harm caused by the accident, it can help alleviate some of the burdens and provide a sense of justice. This case demonstrates the importance of experienced legal representation in achieving a fair and just outcome for those pursuing compensation for injuries on buses and public transport.
